The Provider

This website is hosted by Wix but owned and operated by Sonia Fernández (The Provider). These Terms set forth the terms and conditions under which you may engage professional services. All general content, trends, and insights are provided for informational purposes only and do not constitute professional advice tailored to your specific business needs. By requesting a quote, approving a project, or using my services, you (the "Client") agree to the following terms and conditions.

Services

The provider offers customised website consulting, digital marketing strategy, and related creative services as specified in the quote or proposal. Only the services listed in the quote are included. Any additional work requires a separate agreement or an updated quote.

Clients are responsible for reading the full service description before approving any quote. Approval of a quote creates a legally binding agreement to purchase the specified services.

Eligibility

To engage our services, you must be at least 18 years of age (or the legal age of majority in your jurisdiction) and possess the legal authority to enter into these Terms as a binding agreement. You may not use these services if prohibited by law in your country or jurisdiction.

Client Responsibilities

To ensure proper service delivery, the Client agrees to:

  • Provide all required information, materials, and access in a timely manner.

  • Respond to feedback requests promptly.

  • Nominate a single contact person for communications if applicable.

Working Hours

Unless otherwise stated in the quote, time allocation is flexible and project-based. Any work beyond the agreed scope or hours will be quoted separately and must be approved by the Client before proceeding.

Duration

Each project or engagement begins when the Client approves the quote and lasts until completion of the agreed services, unless otherwise agreed in writing. Ongoing services renew monthly unless either party gives at least 15 days' written notice.

Fees & Payment

Fees are stated in the quote and are charged in euros via bank transfer to the Spanish bank account stated in the quote or invoice. 
  
Unless otherwise agreed:

  • An initial deposit may be required before work begins.

  • Invoices are payable within 7 days by bank transfer.

  • Late payments may be subject to interest at 10% per annum.

  • Prices may be adjusted annually in line with the Spanish CPI for the services sector.

 

Prices may be changed at any time for future services, and pricing errors may be corrected. Pricing information is available in individual quotes.

Confidentiality

All information provided by the Client will be kept confidential during the project and for 5 years after completion.

Data Protection

Services comply with EU GDPR and the Spanish LOPDGDD regarding the collection and processing of personal data.

Website Use Restrictions

You are specifically restricted from:

  • Publishing any website material in other media without permission.

  • Selling, sub-licensing, or commercialising any website content.

  • Using this website in ways that may damage its functionality.

  • Using this website contrary to applicable laws and regulations.

Intellectual Property Protection

All materials, strategies, methodologies, content, and deliverables created by the provider remain her exclusive intellectual property unless explicitly transferred in writing. Clients may use deliverables for their intended business purposes but may not resell, redistribute, or claim ownership of the work methods or proprietary strategies.

Service Quality & Revisions

If the Client believes there is a defect or error in the services provided, notification must be made within 5 business days so corrections can be addressed within 10 business days.

Termination

Either party may end the engagement with 15 days' written notice, or immediately in case of serious breach of these terms (e.g., non-payment, misuse of work, violation of laws).

Jurisdiction

These terms are governed by the laws of Spain. Any disputes will be resolved in the courts of Málaga.

These terms apply alongside any specific agreement in the quote.
By accepting a quote, making a payment, or requesting services, the Client confirms acceptance of these terms.

Limitation of Liability

To the maximum extent permitted by Spanish law, the provider shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, revenue, data, or business opportunities, arising from the use of services or inability to achieve expected results.

The maximum liability for any claim shall not exceed the total amount paid by the Client for the specific services in question.

Indemnification

The Client agrees to indemnify and hold the provider harmless from any claims, damages, or expenses (including legal fees) arising from the Client's use or misuse of services, violation of these terms, or any third-party claims related to the Client's business decisions or implementations.

Modification of Terms

These terms may be modified at any time. Material changes will be communicated via email or website notice. Continued use of services after changes constitutes acceptance of the new terms.
